PRIVACY POLICY AND TERMS OF USE

1. INTRODUCTION

The Clean Production Action websites, which as of this writing include cleanproduction.org, greenscheenchemicals.org, bizngo.org, chemicalfootprint.org, and iehn.org,   (“Site” or “Sites”) provide information regarding Clean Production Action (“Clean Production Action” or “Organization”), its services for potential customers of the Organization, and its programs.  This “Privacy Policy and Terms of Use” (referred to below as the “Terms”) has been written to describe the conditions under which this Site is being made available to you. The Terms discuss important limitations about the way you may use and rely upon materials you find on the Site. Read these Terms carefully. By using this Site, you will be deemed to have accepted them. If you do not accept the Terms, you may not use this Site.
 

2. USE OF SITE

We authorize you to view and download the materials at this Site only for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices contained in the original materials or any copies of the materials. You may not modify the materials at this Site in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose. Any use of these materials on any other website or networked computer environment for any purpose is prohibited. The materials at this Site are copyrighted and any unauthorized use of any materials at this Site may violate copyright, trademark, and other laws. If you breach any of these Terms, your authorization to use this Site automatically terminates and you must immediately destroy any downloaded or printed materials.
 

3. INFORMATION COLLECTED AND RECEIVED

We are the sole owner of the information collected on the Site.  We collect personally identifiable information (“Personal Data”) from our users at several different points on the Site. We gather two types of information from you when you visit the Site: information you submit to us voluntarily, whether for registration, newsletter or other purposes, or information our Site gathers automatically. Personal data does not include data where the identity has been removed (anonymous data). We may collect, use, and store different kinds of personal data to provide you Services as follows:
 

(a) Customer Account and Registration Data:

This includes information you provide to create your account with us or to register for events, webinars, surveys, newsletters, etc., or to download documents or recordings, and may include, but is not limited to, first and last name, billing information, a password, a valid email address, company affiliation, address, and job title.  If you do not wish to receive information from us, you may opt-out of receiving future mailings by responding as directed in the opt-out instructions or by contacting us directly at ops@cleanproduction.org.
 
We do not want to receive confidential or proprietary information from you through this Site. Any material, information or other communication (“Communications”) you transmit or post to this Site will be considered non-confidential and non-proprietary.  We will have no obligations with respect to the Communications, other than to treat your personally identifiable information in accordance with our privacy practices described herein.  The exception to this is if you are a Responder in the Chemical Footprint Project Survey (“Survey” or “Survey Site”).  Confidential information submitted to us when you are logged into the secure Survey will be considered and treated by us as confidential. 
 

(b) Service Data (including Session and Usage data):

When you use our Services, we receive information generated through the use of the Service, either entered by you or others who use the Services with you, for example, schedules or attendee information, or from the Service infrastructure itself, for example, duration of session, use of webcams, connection information, etc. We may also collect usage and log data about how the services are accessed and used, including information about the device you are using the Services on, IP addresses, location information, language settings, what operating system you are using, unique device identifiers and other diagnostic data to help us support the Services.
 

(c) Third Party Data:

We may receive information about you from other sources, including publicly available databases or third parties from whom we have purchased data, and combine this data with information we already have about you. We may also receive information from other affiliated companies that are a part of our network. This helps us to update, expand and analyze our records, identify new prospects for marketing, and provide products and services that may be of interest to you.
 

(d) Location Information:

We may collect your location-based information for the purpose of providing and supporting the service and for fraud prevention and security monitoring. If you wish to opt-out of the collection and use of your collection information, you may do so by turning it off on your device settings.
 

(e) Device Information:

When you use our Services, we automatically collect information on the type of device you use, operating system version, and the device identifier (or "UDID").
 

(f) Cookies and Similar Information

Technologies such as cookies, beacons, tags and scripts are used by the Organization. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the Site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies on an individual as well as aggregated basis. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our site. Our Site follows browser do-not-track signals.

(ii) Social Media Widgets

The Site may interface with social networks to allow users to post content from the Site on various social platforms (Twitter, LinkedIn, Facebook, YouTube, etc.)  To understand how and what information is collected and what cookies are installed by the third-party, check the Privacy Policy of their social platform.
 

(iii) What Are Your Choices Regarding Cookies

Certain countries, including members of the European Union, require your consent to the use of cookies when you visit our Site.  Please note that you will not be able to opt out of receiving certain cookies that are strictly necessary for the delivery of a service requested by you.
 
If you do not accept cookies, your browser can be set to not automatically accept cookies from being stored or to inform you whenever a site requests storing a cookie. Previously stored cookies can also be deleted through the browser. See the help pages of your browser for more information. However, be aware that some areas or functions of the Site depends on cookies and may not work if you delete or not to accept cookies.
 

4. USE OF INFORMATION WE COLLECT

Clean Production Action may access (which may include, with your consent, limited viewing or listening) and use the data we collect as necessary as required by law to: (a) provide and maintain the Services; (b) address and respond to service, security, and customer support issues; (c) detect, prevent, or otherwise address fraud, security, unlawful, or technical issues; (d) fulfill our contracts; (e) improve and enhance the Services; and/or (f) provide analysis or valuable information back to our Customers and users.
Some specific examples of how we use the information:
  • Create and administer your account
  • Send you an registration, download, subscription, order, or similar confirmations
  • Facilitate and improve the usage of the services you have ordered
  • Assess the needs of your business to determine suitable products
  • Send you product updates, marketing communication, and service information
  • Respond to customer inquiries and support requests
  • Conduct research and analysis
  • Display content based upon your interests
  • Analyze data, including through automated systems and machine learning to improve our services and/or your experience
  • Provide you information about your use of the services and benchmarks, insights and suggestions for improvements
  • Market services of our third-party partners
Clean Production Action also collects and stores meeting attendee information to fulfill our obligation to our customers and provide the Services. With your consent, we may also directly provide product and other CPA related information to attendees. The Organization will retain your information as long as your account with us is active, to comply with our legal obligations, to resolve disputes, and enforce our agreements.
If you wish to cancel your account or for us to stop providing you services, or if we hold personal information about you and you want it to be removed from our database or inactivated, please contact us at ops@cleanproduction.org.
 
Personal Data will not be kept for longer than is necessary for the purpose (s) for which it was collected.  In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on Clean Production Action’s Document Retention and Destruction Policy.  Notwithstanding this, we may retain your Personal Data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another person.
 

5. SECURITY

While we try to prevent third party access to personally identifiable information, internet communications are not always secure. We cannot promise you that third parties cannot access your personally identifiable information.  It is a condition of your use of this Site that you agree we are not liable for any such disclosure.
 

6. INFORMATION SHARING

Ensuring your privacy is important to us. We do not share your personal data with third parties except as described in this Privacy Policy. We may share your personal information with (a) third-party service providers; (b) business partners; (c) affiliated companies within our corporate structure; and (d) as needed for legal purposes. Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.
Examples of how we may share information with service providers include:
  • Fulfilling orders and providing the services
  • Payment processing and fraud prevention
  • Providing customer support
  • Sending marketing communications
  • Conducting research and analysis
  • Providing cloud computing infrastructure
Examples of how we may disclose data for legal reasons include:
  • As part of a merger, sale of company assets, financing or acquisition of all or a portion of our business by another company where customer information will be one of the transferred assets.
  • As required by law, for example, to comply with a valid subpoena or other legal process; when we believe in good faith that disclosure is necessary to protect our rights, or to protect your safety (or the safety of others); to investigate fraud; or to respond to a government request.
  • We may also disclose your personal information to any third party with your prior consent.
While Clean Production Action does not, and has no plans to, advertise on the Site, and thus is not collecting personally identifiable information in order to entice advertisers, some third parties collect information about users to provide interest-based advertising elsewhere, including across browsers and devices.  These third parties may use the information they collect on our Site to make predictions about your interests in order to provide you ads (from us) across the internet.  Some of these third parties may participate in an industry organization that gives users the opportunity to opt out of receiving ads that are tailored based on your online activities.  Due to differences between using apps and websites on mobile devices, you may need to take additional steps to disable targeted ad technologies in mobile apps and mobile based websites.  Many mobile devices allow you to opt out of targeted advertising for mobile apps using the settings within the mobile app or your mobile device.  For more information, please check your mobile settings. 
 

7. YOUR LEGAL RIGHTS

You have the legal rights to:

  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons, in which case we will notify you at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

8. GENERAL DATA PROTECTION REGULATION

If you are a resident of or are located in the European Economic Area (“EEA”), you may also have certain rights under the General Data Protection Regulation (“GDPR”).  Personal Data you provide on the Site is only collected in accordance with the legal reasons described above, and may be transmitted outside of the EEA to Clean Production Action (or computer servers maintained for its benefit) consistent with those reasons.
 
If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

Note that, if you are in the EEA, we may transfer your Personal Data outside of the EEA, including to the United States.  By way of example, this may happen if your Personal Data is transferred to our servers located in a country outside of the EEA. These countries may not have similar data protection laws to the EEA. By submitting your Personal Data, you’re agreeing to this transfer, storing or processing. If we transfer your information outside of the EEA in this way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this policy.
 

9. BUSINESS TRANSITIONS 

In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred.  You will be notified via prominent notice on our Site of any such change in ownership or control of your personal information.
 

10. DISCLAIMERS 

The materials at this site are provided “as is” without warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.  Our obligations with respect to our products and services are governed solely by the agreements under which they are provided and nothing on this Site should be construed to alter such agreements. We further do not warrant the accuracy and completeness of the materials at this Site. We may make changes to the materials at this Site, or to the products and prices described in them, at any time without notice. The materials at this Site may be out of date, and we make no commitment to update the materials and services at this Site. Information published at this Site may refer to products, programs or services that are not available in your country. Applicable law may not allow the exclusion of implied warranties, so this exclusion may not apply to you.

In no event will we, our suppliers, or other third parties mentioned at this site be liable for any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information or services contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not we have been advised of the possibility of such damages. If your use of the materials, information or services from this site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof. Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so these limitations or exclusions may not apply to you.

13. AGE LIMITATION

This Site is not directed to person under the age of 16. If you become aware that your child has provided us with personal information without your consent, please contact us at ops@cleanproduction.org or 781-391-6743 x102. We do not knowingly collect or solicit information from, market to or provides services to persons under 16 years old. If we become aware that a person under 16 has provided us with personal information, we take steps to remove such information and terminate the person’s account.
 

14. YOUR CALIFORNIA PRIVACY RIGHTS

We administer this Site from our offices in the Commonwealth of Massachusetts, USA.  We make no representation that materials or services at this Site are appropriate or available for use outside the United States, and access to them from territories where their contents are illegal or prohibited. You may not use or export or re-export the materials or services at this Site or any copy or adaptation in violation of any applicable laws or regulations including without limitation U.S. export laws and regulations. If you choose to access this Site from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws.
